On August 6, 2024, Session Law 2024, c. 150, s. 51 (an Act relative to the Affordable Homes Act) increased the amount of the homestead exemption that is created by written declaration, from $500,000.00 to $1,000,000.00. This change amends section 1 (the definition section) of Mass. General Law chapter 188, the Homestead Statute. According to language in the Amendment, the increase takes effect immediately. What is a Declaration of Homestead\/Homestead protection?
<\/b>
An estate of homestead is a type of protection for a person\u2019s principal residence. Even if you don\u2019t declare a homestead exemption with the Registry of Deeds, you\u2019ll still benefit from an automatic homestead protection of one hundred and twenty-five thousand dollars ($125,000).<\/p>\n

While this automatic protection may be sufficient to protect a deposit made upon your estate, it\u2019s not likely enough coverage to protect the full value of your home. To protect the value of your property up to one million dollars ($1,000,000) per residence, per family, you must file a document called a \u201cDeclaration of Homestead<\/a>\u201d. You can file this form at the Registry of Deeds in the county or district where your property is located, referencing the title\/deed to the property.<\/p>\n

Who can file a Homestead protection?<\/b><\/p>\n
